Welcome to Dataprism. These Terms of Service ("Terms") govern your use of our website (dataprism.dev), API platform, services, and applications. By accessing or using our service, you agree to be bound by these Terms.

• "Account" refers to the unique account created for you to access our Service.
• "Content" includes all data, text, graphics, images, visualizations, software, and other materials accessed through our API.
• "Request" refers to any API call made to our endpoints using your API key.
• "MCP" refers to Model Context Protocol, an integration standard for AI tools and agents.

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 18 years old or have legal capacity to enter into binding contracts
• One person or entity may not maintain more than one account without prior approval
• You must provide a valid email address for account verification

3.2 Account Security

You are responsible for all activities that occur under your account and for maintaining the security of your API keys. Please notify us immediately at support@dataprism.dev of any unauthorized use of your account, API keys, or any other breach of security.

3.3 API Key Management

• Keep your API keys confidential and secure
• Do not share API keys in public repositories or client-side code
• Rotate API keys regularly for security best practices
• You are fully responsible for all requests made using your API keys
• We reserve the right to revoke API keys that show suspicious activity

4. Acceptable Use Policy

4.1 Prohibited Activities

You agree NOT to use our Service to:

• Violate any applicable local, national, or international laws or regulations
• Infringe on intellectual property rights of third parties
• Transmit harmful, offensive, illegal, or malicious content
• Spam, phish, or engage in fraudulent activities
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with, disrupt, or overload our Service or servers
• Circumvent rate limits or other technical restrictions
• Scrape or harvest data for resale or redistribution without authorization
• Use the Service to compete directly with Dataprism

• Reverse engineer or attempt to extract source code from our APIs

4.2 Rate Limits and Fair Use

• All accounts are subject to rate limits based on subscription tier
• Excessive usage that impacts service quality for other users may result in temporary throttling
• Automated requests must respect rate limit headers
• Sustained violations of rate limits may result in account suspension

4.3 Encouraged Activities

• Create innovative applications and integrations using our APIs
• Use our Service for legitimate research, analytics, and business purposes
• Respect data sources' terms of service and robots.txt directives
• Provide constructive feedback to help us improve
• Integrate via MCP protocol for AI-assisted workflows

5. Intellectual Property Rights

5.1 Our Rights

Dataprism is a product and platform owned and operated by Cognitobit Innovations Private Limited, a company registered in India. All rights, title, and interest in and to the Dataprism platform belong to Cognitobit Innovations Private Limited.

The Service and its original content, features, functionality, API design, documentation, and visualizations are owned by Cognitobit Innovations Private Limited and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Dataprism name, logo, and associated branding are trademarks of Cognitobit Innovations Private Limited. You may not use these without explicit written permission.

5.2 Your Rights

You retain all rights to applications, content, and derivative works you create using our Service. However, by using our Service, you grant us a limited, non-exclusive, worldwide license to:

• Host, store, and process your API requests
• Display usage statistics and aggregated data insights
• Use anonymized data to improve our Service

5.3 Third-Party Data and Content

Data retrieved through Dataprism APIs may be sourced from third-party platforms (Reddit, LinkedIn, Twitter/X, YouTube, Google, Meta, etc.). You are responsible for:

• Complying with terms of service of data sources
• Respecting intellectual property and privacy rights
• Using data only for lawful and authorized purposes
• Attributing data sources where required

Dataprism provides data "as-is" from publicly available sources and makes no warranty regarding ownership, accuracy, or completeness of third-party content.

5.4 AI-Generated Content and Visualizations

Content generated through our visualization APIs (Mermaid, Graphviz, QuickChart, WordCloud, ApexCharts, Seaborn, Matplotlib) and summarization tools may be subject to specific licensing terms. You are responsible for ensuring your use complies with applicable laws and licenses.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Pricing, Payment Terms & Refunds

Dataprism operates on a transparent pay-as-you-go pricing model:

• Free tier includes 500 complimentary API requests
• Beyond free tier, you pay only for successful requests
• Pricing varies by endpoint and usage volume with tiered discounts
• Failed requests (4xx/5xx errors) are not charged

7.2 Billing and Payments

• Usage is calculated and billed monthly
• Payments are processed through secure third-party payment processors
• All fees are charged in advance or based on actual usage
• You authorize us to charge your selected payment method for all applicable fees
• Failed payments may result in service suspension after grace period

• We reserve the right to modify pricing with 30 days advance notice
• Existing subscriptions will be honored at current rates until renewal
• Continued use of the Service after price changes constitutes acceptance

7.5 Taxes

You are responsible for all applicable taxes, duties, and government charges in your jurisdiction. Prices displayed do not include applicable taxes unless explicitly stated.

8. Service Availability

8.1 Service Level

While we strive to maintain high availability and reliability, we do not guarantee uninterrupted, error-free access to our Service. We may experience downtime for:

• Scheduled maintenance (announced in advance)
• Emergency maintenance (may occur without notice)
• Factors beyond our control (network issues, cloud provider outages, etc.)

8.2 Uptime Target

• We target 99.5% uptime for API services
• This is a target, not a guarantee or service-level agreement (SLA)
• Scheduled maintenance windows are excluded from uptime calculations

8.3 Service Modifications

We reserve the right to:

• Add, modify, or discontinue API endpoints with reasonable notice
• Update API response formats and schemas
• Implement new features or deprecate old ones
• Change technical specifications or documentation

9. Termination

9.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in your profile settings
• Contacting us at support@dataprism.dev

Upon termination, your access to the Service will cease immediately. You will remain responsible for any charges incurred before termination.

9.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, if you:

• Breach these Terms
• Engage in activities that harm our Service, infrastructure, or other users
• Fail to pay applicable fees after grace period
• Violate applicable laws or third-party rights
• Provide false or misleading information

9.3 Effect of Termination

Upon termination:

• Your API keys will be immediately revoked
• Your access to the Service will be disabled
• We may delete your account data after a reasonable retention period
• Provisions regarding intellectual property, liability, and dispute resolution survive termination

10. Limitation of Liability

10.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA.

10.2 Limitation of Damages

DATAPRISM SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Business interruption or loss of goodwill
• Damages arising from use or inability to use the Service
• Damages resulting from unauthorized access to your account
• Errors, inaccuracies, or omissions in third-party data
• Actions taken based on data retrieved through our APIs

WHETHER ARISING FROM CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.3 Maximum Liability

Our total cumulative liability under these Terms will not exceed the lesser of:

• The total amount you paid to Dataprism in the 3 months preceding the claim, OR
• $100 USD

11. Indemnification

You agree to indemnify, defend, and hold harmless Cognitobit Innovations Private Limited, Dataprism, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Your violation of applicable laws or regulations
• Content or data you submit through the Service
• Unauthorized use of your API keys resulting from your failure to secure them

12. Dispute Resolution

12.1 Informal Resolution

Before initiating formal proceedings, you agree to attempt informal resolution by contacting us at support@dataprism.dev. We will work in good faith to resolve disputes amicably.

12.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, specifically the laws applicable in Haryana State, without regard to its conflict of law provisions.

12.3 Jurisdiction

Any disputes arising from these Terms or the Service shall be resolved in the competent courts located in Rewari, Haryana, India. You consent to the personal jurisdiction of these courts.

12.4 Class Action Waiver

You agree to resolve disputes with Dataprism on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative actions against Dataprism.

13. Compliance and Legal Use

13.1 Export Compliance

You agree to comply with all applicable export and import control laws and regulations. You will not use the Service in any jurisdiction where its use is prohibited.

13.2 Data Protection Laws

You are responsible for complying with applicable data protection laws (GDPR, CCPA, etc.) when processing data retrieved through our APIs, particularly personal data.

13.3 Platform Terms Compliance

When accessing data from third-party platforms through our APIs, you agree to comply with those platforms' terms of service, API terms, and usage policies.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through:

• Email notification to registered users
• Prominent notice on our website
• Updates to the "Last updated" date at the top of this document

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and may terminate your account.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any supplemental agreements, constitute the entire agreement between you and Cognitobit Innovations Private Limited regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

15.5 No Agency

These Terms do not create any agency, partnership, joint venture, or employment relationship between you and Dataprism.

15.6 Force Majeure

We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, or network infrastructure failures.
